Colorado set to impose more regulations on CBD products

The FDA’s involvement could change the Colorado CBD scene

Last Friday, the Food & Drug Administration (FDA) conducted a hearing designed to help it better understand the cannabis industry and, specifically, the cannabis compound cannabidiol (CBD). To say that the hearing was a success and reached its goal would be a gross exaggeration, but one of the takeaways is that the FDA could move toward implementing more stringent requirements over CBD products. If this happens, Colorado’s growing CBD market could suffer.

Depending on the direction the FDA decides to take now, it could influence how CBD products in Colorado are manufactured and sold. The FDA could also decide to place an outright ban on products that contain CBD and prevent it from being used as an additive in foods and beverages, at least in the US.

One company that makes hemp-derived CBD products, Flora’s Mercantile, has been helping a lot of area residents and realizes that changes are coming. Its owner, Chris Bedrosian, hopes, however, that the FDA will recognize the benefits of CBD and believes that, as long as producers and merchants play by the rules, there won’t be any issues. She knows that companies cannot make unsubstantiated claims and that what her customers do after purchasing the product is out of her control. She asserts, “I have a customer using our salve on his dog’s cancer, and it’s going away. That’s not me. That’s them. If you are overtly making claims about your products, they will shut you down in a heartbeat.”

Colorado already monitors, in some locations, CBD. Denver and state regulators have implemented procedures to evaluate the industry and food products, but whether or not these procedures will continue after the FDA goes public on its stance remain to be seen.
